Terms of service

Everything in [square brackets] must be completed by the store owner before launch.

1. Scope

These terms apply to all orders placed by consumers through siderelle.myshopify.com (the "shop") with [Company legal name], [address] ("Siderelle", "we"). A consumer is any person who orders for purposes that are mainly outside their trade or profession. Mandatory consumer protection rules of the country where you live remain unaffected.

2. Contract

The product pages are not a binding offer. By clicking "Pay now" (or the equivalent button) at checkout you make a binding offer to buy the items in your bag. We confirm receipt of your order by email straight away; the contract is concluded when we send a second email confirming dispatch, or when we collect payment, whichever comes first. The contract language is English; the shop is also available in German, French, Dutch and Polish. We store the contract text, and you receive it with your order confirmation.

3. Prices and payment

All prices are in euro (or the local currency shown) and include the statutory VAT of your country. Delivery costs are shown before you place the order: free tracked delivery for orders from €59, €4.90 below. The available payment methods are shown at checkout. Payment is due when you place the order.

4. Delivery

We deliver to all 27 EU member states. Orders leave within 1–3 business days and usually arrive within 5–10 business days. Import VAT is prepaid, so there are no customs charges on delivery. Details are in our shipping policy.

5. Retention of title

The goods remain our property until they have been paid in full.

6. Right of withdrawal

As a consumer you have a statutory 14-day right of withdrawal. The details, and a model withdrawal form, are in our refund policy. In addition we voluntarily accept returns of unworn pieces within 30 days of delivery; this does not limit your statutory rights.

7. Legal guarantee

The statutory legal guarantee for defects applies (at least two years from delivery in the EU). Please contact [support email address] if a piece arrives damaged or develops a defect.

8. Product information

Our stones are lab-created moissanite (silicon carbide). They are not diamonds and are always described as moissanite. The metal is 925 sterling silver with an electroplated finish. Photos and the 3D views represent the piece as accurately as possible; small differences in colour on screens are possible.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under product liability law. For slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract.

10. Dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

11. Applicable law

The law of [country of the company] applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you live.
